At these physical locations, it organizes live poker activities, in accordance with the applicable legislation and the guidelines of the competent control authorities. In addition, Pokahnights manages a website with information about the offer, the club and initiatives to support the community.

These Terms and Conditions for users of the Pokahnights Orbit on Days of Poker ("Terms") constitute a binding agreement between you and Pokahnights. They apply to both membership of the Pokahnights poker club and the use of the Pokahnights orbit, Pokahnights' digital channel on the Days of Poker platform.

The Terms govern your rights and obligations to participate in poker activities at Pokahnights' Pokah Rooms, physical locations where members can play live poker on different days and according to various models.

The Terms and Conditions also apply to your participation in the Pokahnights orbit. This is a digital zone in Days of Poker. Members who follow this orbit can communicate with each other and with Pokahnights.

Pokahnights offers its services both physically and digitally. The physical operation takes place in the Pokahrooms, our live poker venues. We are active digitally through three channels: our own website, external digital platforms such as social media and the Pokahnights Orbit on Days of Poker, and through online poker activities.

3.1 Play live in our rooms

This section covers participation in the live poker events hosted by Pokahnights in the Pokahrooms, our private clubs. Only members can enter these clubs, after payment of an annual membership fee. A membership gives access to a specific Pokahroom from Pokahnights. On the websitepokahnights.com/info you will find the recent rates for memberships.

Those who play physically must take into account a number of important rules, agreements and practical matters. In the following articles we will explain these provisions, so that you as a player can participate in our live events well informed and correctly.

3.1.1 Data processing & privacy

When participating in our live poker events, Pokahnights may process certain personal data, for example for registration, verification or reporting. The way in which we handle this data is explained in detail in our separate Privacy Policy. By participating in our activities, you agree to this processing as described therein. We recommend that you carefully read the Privacy Policy, also available here in the paperwork section, for more information about what data we collect, why we do it and how we secure it.

3.1.2 Intellectual Property

All on- and offline elements - including but not limited to software, photos, designs, illustrations, artwork, videos, music, sound, coding, graphic elements, technology, processes, texts, interfaces, interactive elements, methodology, names, logos and trademarks - are the exclusive property of Pokahnights or its licensors. Unauthorized use is strictly prohibited.

3.1.3 Photo and video material

During live events, photos and video images can be taken in the Pokahrooms for reporting, promotion and community work. This footage can be shared via Pokahnights digital channels, such as our website, social media, the Pokahnights Orbit or other communication platforms.

Participation in certain events implies permission for the use of visual material. At Pokahnights Daily Events, there is basically no obligation to appear on screen. At larger events, such as finals, big tickets and series, footage can be made. In that case, you will be informed about this in advance or on the spot.

For specific campaigns, such as the Pokahchamp, taking an official photo is part of the conditions of participation. Only players who agree to this will be eligible for the title and the corresponding payout. This is essential for the credibility, visibility, and promotional value of the championship.

By participating in our events, you accept these terms and conditions and give permission for possible use of images, unless explicitly stated or agreed otherwise.

3.1.4 Application of the Official Poker Rules

All live poker activities organized by Pokahnights follow the rules as laid down by the Poker Tournament Directors Association (TDA). These rules ensure that our tournaments run fairly, consistently, and transparently.

Players are expected to know the basic rules of poker and to respect the guidelines of the TDA. The tournament management of Pokahnights always reserves the right to make decisions in line with these rules and with a view to fair play and fun.

The decisions of the tournament director or floor staff are binding. They also reserve the right – if they deem it necessary – to deviate from the standard rules, without further justification, in order to monitor the course of the game or the atmosphere of the event.

3.1.5 General house rules

In addition to the official poker rules, Pokahnights also has house rules that contribute to a safe, respectful and pleasant playing environment. These rules are binding on all members and participants in our live poker activities.

The following behaviors are strictly prohibited and can lead to immediate and permanent exclusion from the club:

• the use or possession of drugs on or around the playing location,

• committing or threatening violence in any form,

• using abusive, insulting or discriminatory language,

• threatening, intimidating or ridiculing other members,

• incitement to hatred, violence or extremism, regardless of the context,

• disseminating sexually explicit, racist, xenophobic or other inappropriate content,

• sending spam, advertising, or other unwanted messages.

Pokahnights counts on a player to do everything he can to act according to the rules. Any breach that is identified can lead to:

• a written warning,

• exclusion from the club for a period of 3 months,  

• exclusion from the club for a period of 6 months,  

• Permanent exclusion from the club.

3.1.6 Additional House Rules on Poker

• Random Seating: The seatings are assigned randomly. You will not be asked to choose a specific seat (except in medical exceptions). The only exception is that you have the right to ask for another table (if possible) in the event of a re-entry.

• Languages: The working languages during a hand are Dutch, French or English. If another language is spoken during the hand, your hand is dead.

• GSM usage: Mobile phone use at the table is allowed as long as no communication is established while you are in the hand.

• Rabbithunting: It is forbidden to "rabbit hunt" (looking at the flop, turn or river that is yet to come, both during and after the hand).

• Potato chips: Chips must always be clearly visible, i.e. large chips in front and stacks preferably per 20 or 10. Touching someone else's chips is not allowed, to prevent cheating and collusion.

• TD is the Boss: The Tournament Director (TD) has the final decision. What the TD decides should always be followed up.

• Respect for Each Other and Material: Treat each other and the poker equipment with respect.

• Alcohol restrictions: We reserve the right to refuse alcohol if certain behavior crosses the line.

• Spectators: Players who are no longer in the game should no longer be at the table. Watching is allowed, but from a distance.

• Show Cards: No hole cards may be shown while the hand is in progress. In an all-in situation, all hands of the players involved are turned open.

3.1.7 Liability, Indemnification, Cameras

Pokahnights assumes no responsibility for failures, interruptions or unauthorized use of data. You agree to indemnify Pokahnights from any claims or damages arising out of your use of the poker room.

Pokahnights is not responsible for any accidents and theft.  

Cameras have been placed in the room of Pokahnights for everyone's safety. The images are monitored to ensure safety in the rooms and to prevent any fraud.  

3.1.8 Payments

In Pokahroom Wilrijk, a player can pay for buy-ins, rebuys, drinks and food in the following ways:

• cash

• bank contact

• MasterCard/Visa

• the physical Pokahnights voucher

• the digital Pokahnights voucher

In Pokahroom Middelkerke, a player can pay buy-ins and rebuys in the following ways:

• cash

• bank contact

• MasterCard/Visa

• the physical Pokahnights voucher

• the digital Pokahnights voucher

3.1.9 Pokahnights Vouchers

The Pokahnights vouchers are valid for a period of 12 months after issue. Vouchers are not redeemable for cash and cannot be transferred to other users.

The digital voucher is awarded via the Days of Poker app and is only usable if the user is currently following the Pokahnights Orbit.

Once a user unfollows the Pokahnights Orbit, the remaining balance on the voucher will be temporarily suspended and will not be usable. When the user follows the Orbit again, the voucher is automatically reactivated.

The original 12-month validity period will remain in force regardless of any interruptions due to untracking of the Orbit.

The physical voucher will be awarded to a member in the Pokahnights poker room.

3.1.10 Corrections in case of administrative errors

In case of payment by cash, debit card or Mastercard/visa

Pokahnights strives for a correct organization of all poker activities. In the event of an administrative error in the registration or conduct of a tournament (including, but not limited to, improper processing of bounties, prize money, registration fees or payout structures), Pokahnights reserves the right, upon becoming aware of the error, to take corrective action. These measures may include:

• Correcting payouts

• the additional payment of underpaid prize money

• reclaiming overpaid prize money

Pokahnights will make reasonable efforts to inform affected players as soon as possible. Players acknowledge and accept that they are obliged to refund any amounts they have received in error upon simple request.

Pokahnights' liability is limited to the correct execution of the tournament format as intended at the start of the event. Pokahnights is not liable for indirect, consequential or immaterial damage. By participating in an event, players accept these terms and conditions.

In case of payment via vouchers

Pokahnights can issue vouchers through its platforms, including Days of Poker. These vouchers can be used for participation in poker events, the purchase of food and beverages, or other products and services offered by Pokahnights. The value stated on a voucher is managed by Pokahnights and can be adjusted in the event of administrative errors, technical failures or other errors. Pokahnights reserves the right to:

• To add or deduct funds from a voucher in order to restore the correct situation

• declare a voucher invalid in whole or in part if an error, misuse or technical malfunction is detected

• adapt the conditions for the use of vouchers, provided that clear communication is given to the players concerned

By using a voucher, the user accepts these terms and conditions.

Pokahnights counts on members to do everything they can to act according to the rules. Pokahnights reserves the right to take appropriate measures in the event of violations of these rules,

Everyone who follows the Orbit must always communicate with each other respectfully, correctly and appropriately, both via the chat function and on other interactive parts of the platform.

It is expressly forbidden to:

• Use abusive, insulting or discriminatory language;

• Threaten, intimidate, or ridicule any other member;

• Inciting hatred, violence, or any form of extremism, regardless of the context;

• Send sexually explicit, racist, xenophobic, or otherwise inappropriate messages;

• Spread spam, advertising, or other unwanted messages.

The Pokahnights Orbit reserves the right to remove posts that violate these guidelines without prior warning, and to temporarily or permanently suspend accounts in the event of repeated or serious breaches.

Members who notice such behavior are encouraged to report it immediately to the moderators.

The Pokahnights website or the social media platforms on which Pokahnights is active may contain links to external sites. Pokahnights does not endorse or accept any liability for its content.

5.1 Use by minors or excluded persons

Pokahnights is only open to persons who are legally old enough to participate in poker activities and who are not excluded. Minors or excluded persons may not enter our physical locations (Pokahrooms) under any circumstances to participate in the poker activities.

Pokahnights wants to comply with the legislation and wants to ensure a safe and responsible environment for all members. We therefore reserve the right to verify the identity and age of a user at any time. In order for this verification to run smoothly and correctly, every user of Pokahnights must have a verified Days of Poker account. In a physical location (Pokahroom), an extra check of identity and age can take place.

If a participant is younger than the permitted age, access will be refused or revoked immediately. In case of doubt, access may be temporarily denied until the age is confirmed. Persons who do not receive access do not claim any winnings from poker activities organized by Pokahnights. Any buy-in amounts are non-refundable.

5.2 Privacy Policy

Your membership in Pokahnights and tracking the Pokahnights Orbit is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information.

5.3 Governing Law and Jurisdiction

These Terms and Conditions are governed by Belgian law. Disputes are settled exclusively by the courts of Antwerp.

5.4 Changes to the Terms and Conditions

Pokahnights may update these Terms and Conditions. Important changes will be communicated via the Days of Poker platform or e-mail. Continuing to use the Platform implies your acceptance of the updated Terms. We advise all followers of the Pokahnights orbit to regularly reread the documents in the paperwork section.
