In these physical locations, it organizes live poker activities, in accordance with applicable legislation and the guidelines of the relevant regulatory bodies.
Additionally, Pokahnights manages a website with information about its offerings, the club, and community support initiatives.

These Terms and Conditions for Users of the Pokahnights Orbit on Days of Poker ("Terms") constitute a binding agreement between you and Pokahnights. They apply both to membership in the Pokahnights poker club and to use of the Pokahnights orbit, Pokahnights' digital channel on the Days of Poker platform.

The Terms define your rights and obligations to participate in poker activities in Pokahrooms of Pokahnights, physical locations where members can play live poker on various days and according to various models.

They also apply to your participation in the Pokahnights Orbit, a digital zone on Days of Poker. Members who follow this Orbit can communicate with each other and with Pokahnights.

Pokahnights offers its services both physically and digitally. The physical operations take place in the Pokahrooms, our live poker venues. Digitally, we are active through three channels: our own website, external digital platforms such as social media and the Pokahnights Orbit on Days of Poker, as well as online poker activities.

3.1 Playing Live in Our Rooms

This section covers participation in the live poker events organized by Pokahnights in the Pokahrooms, our private clubs. Only members can enter these clubs, after paying an annual membership fee. A membership gives access to a specific Pokahroom of Pokahnights. On the websitepokahnights.com/info you can find recent membership rates.

Anyone participating physically must respect a number of important rules, agreements, and practical matters. The following articles clarify these provisions so that you, as a player, can participate in an informed and correct way at our live events.

3.1.1 Data Processing & Privacy

When participating in our live poker events, Pokahnights may process certain personal data, for example for registration, verification, or reporting purposes. The way we handle this data is detailed in our separate Privacy Policy. By participating in our activities, you agree to this processing as described therein. We recommend reading the Privacy Policy carefully (also available in the administrative section) to learn what data we collect, why we do so, and how we secure it.

3.1.2 Intellectual Property

All digital elements – including but not limited to software, photos, designs, illustrations, artworks, videos, music, sound, code, graphic elements, technology, processes, texts, interfaces, interactive features, methodology, names, logos, and trademarks – are the exclusive property of Pokahnights or its licensors. Unauthorized use is strictly prohibited.

3.1.3 Photo and video material

During live events, photos and videos may be taken in the Pokahrooms for reporting, promotion, and community engagement purposes. This visual material may be shared through Pokahnights' digital channels, such as our website, social media, the Pokahnights Orbit, or other communication platforms.

Participation in certain events implies consent to the use of such imagery. At Pokahnights Daily Events, there is generally no obligation to appear in imagery. At larger events, such as finals, big tickets, and series, imagery may be captured. In such cases, you will be informed beforehand or on-site.

For specific campaigns, such as the Pokahchamp, taking an official photo is part of the participation conditions. Only players who agree to this are eligible for the title and the associated payout. This is essential for the credibility, visibility, and promotional value of the championship.

By participating in our events, you accept these terms and give consent for potential image use unless explicitly stated or agreed otherwise.

3.1.4 Application of the official poker rules

All live poker activities organized by Pokahnights adhere to the rules set by the Poker Tournament Directors Association (TDA). These rules ensure fair, consistent, and transparent tournament operation.

Players are expected to know the basic rules of poker and to respect TDA guidelines. Pokahnights tournament management always retains the right to make decisions aligned with these rules and with the goal of fair play and enjoyment.

The decisions of the tournament director or floor staff are binding. They also reserve the right to deviate from standard rules if deemed necessary to protect the flow or atmosphere of the event.

3.1.5 General house rules

In addition to official poker rules, Pokahnights enforces house rules that contribute to a safe, respectful, and enjoyable playing environment. These rules are binding for all members and participants in our live poker activities.

The following behaviors are strictly prohibited and may result in immediate and permanent expulsion from the club:

• use or possession of drugs on or near the venue;

• committing or threatening violence in any form,

• using coarse, offensive, or discriminatory language,

• threatening, intimidating or ridiculing other members,

• inciting hatred, violence, or extremism in any context;

• send sexually explicit, racist, xenophobic, or otherwise inappropriate messages,

• sending spam, advertising, or other unwanted messages.

Pokahnights expects each player to act according to the rules. Any confirmed violation may result in:

• a written warning,

• exclusion from the club for a period of 3 months, 

• exclusion from the club for a period of 6 months, 

• permanent exclusion from the club.

3.1.6 Additional Poker Rules

• Random Seating: Seatings are assigned randomly. You will not be asked to choose a specific seat (except for medical exceptions). Only exception is for re-entry that you have the right to request a different table (if possible).

• Languages: The languages spoken during a hand are Dutch, French or English. If another language is spoken during the hand then your hand is dead.

• Cell phone use: cell phone use at the table is allowed as long as no communication is established while in hand.

• Rabbithunting: It is forbidden to "rabbithunt" (looking at the flop, turn or river ahead, both during and after the hand).

• Chips: Chips must always be clearly visible, i.e. large chips in front and stacks preferably per 20 or 10. Touching someone else's chips is not allowed, to prevent cheating and collusion.

• TD is the Boss: The Tournament Director (TD) has the final decision. Whatever the TD decides must always be followed.

• Respect for Each Other and Equipment: Treat each other and the poker equipment with respect.

• Alcohol Restrictions: We reserve the right to refuse alcohol when certain behavior is over the line.

• Spectators: Players who are no longer in the game should not be at the table. Watching is allowed, but from a distance.

• Showing cards: no hole cards may be shown while the hand is in progress. In an all- in situation, all hands of the players involved are turned face up.

3.1.7 Liability, Indemnification, and Surveillance Cameras

Pokahnights accepts no responsibility for disruptions, interruptions, or unauthorized use of data. You agree to indemnify Pokahnights against any claims or damages arising from your use of the poker room.

Pokahnights is not liable for any accidents or theft. Cameras are installed in the Pokahnights room for everyone's safety.  

The footage is monitored to ensure security within the rooms and to prevent potential fraud. 

3.1.8 Payments

In Pokahroom Wilrijk, a player can pay buy-ins, rebuys, drinks and food in the following ways:

• cash

• bancontact

• mastercard/visa

• the physical Pokahnights voucher

• the digital Pokahnights voucher

In Pokahroom Middelkerke, a player can pay for buy-ins and rebuys using the following methods:

• cash

• bancontact

• mastercard/visa

• the physical Pokahnights voucher

• the digital Pokahnights voucher

3.1.9 Pokahnights Vouchers

Pokahnights vouchers are valid for a period of 12 months after issuance. Vouchers are non-refundable and non-transferable.

The digital voucher is granted through the Days of Poker app and is only usable when the user is currently following the Pokahnights Orbit.

Once a user unfollows the Pokahnights Orbit, the remaining balance on the voucher is temporarily suspended and cannot be used. When the user follows the Orbit again, the voucher is automatically reactivated.

The original 12-month validity period remains in effect, regardless of any interruptions caused by unfollowing the Orbit.

The physical voucher is granted to a member in the Pokahnights pokerroom.

3.1.10 Corrections in case of administrative errors

In case of payment by cash, debit card or Mastercard/visa

Pokahnights strives to organize all poker activities correctly. In case of an administrative error during the registration or execution of a tournament (including but not limited to incorrect processing of bounties, prize money, registration fees or payout structures), Pokahnights reserves the right to take corrective actions upon detection of the error. These actions may include:

• correcting payouts

• additionally paying out underpaid prize money

• reclaiming overpaid prize money

Pokahnights will make reasonable efforts to inform affected players as soon as possible. Players acknowledge and accept that they are obliged to repay any amounts unduly received upon simple request.

Pokahnights' liability is limited to the correct execution of the tournament format as intended at the start of the event. Pokahnights is not liable for indirect, consequential or non-material damages. By participating in an event, players accept these terms.

In case of payment via vouchers

Pokahnights may issue vouchers through its platforms, including Days of Poker. These vouchers can be used for participating in poker events, purchasing food and drinks, or other products and services offered by Pokahnights.
The value stated on a voucher is managed by Pokahnights and may be adjusted in case of administrative errors, technical issues or other mistakes. Pokahnights reserves the right to:

• credit or debit a voucher to restore the correct situation

• invalidate a voucher entirely or partially in case of error, misuse or technical malfunction

• change the conditions of voucher usage, provided clear communication is given to affected users

By using a voucher, the user accepts these terms and conditions.

Pokahnights accepts no responsibility for malfunctions, interruptions, or unauthorized use of data. You agree to indemnify Pokahnights against any claims or damages arising from your use of their Orbit on Days of Poker.

Pokahnights expects its members to act in accordance with the rules at all times. Pokahnights reserves the right to take appropriate action in case of violations.

Anyone following the Orbit must communicate respectfully, appropriately, and correctly at all times, whether through the chat function or other interactive elements of the platform.

It is expressly forbidden to:

• Use abusive, insulting or discriminatory language;

• Threaten, intimidate or ridicule other members;

• Incite hatred, violence or any form of extremism, regardless of context;

• send sexually explicit, racist, xenophobic, or otherwise inappropriate messages,

• sending spam, advertising, or other unwanted messages.

Pokahnights Orbit reserves the right to delete any messages that violate these guidelines without prior warning and to temporarily or permanently suspend accounts in the case of repeated or serious violations.

Members who witness such behavior are encouraged to report it immediately to the moderators.

The Pokahnights website or the social media platforms on which Pokahnights is active may contain links to external sites. Pokahnights does not endorse nor accept any liability for the content on those sites.

The Pokahnights Orbit may also contain links to external sites. Pokahnights does not endorse nor accept responsibility for their content.

5.1 Use by minors or excluded persons

Pokahnights is only accessible to individuals who are legally permitted to participate in poker activities and who are not excluded. Minors or excluded individuals are under no circumstances allowed to enter our physical locations (Pokahrooms) to participate in poker activities.

Pokahnights aims to comply with the law and provide a safe and responsible environment for all members. We therefore reserve the right to verify a user's identity and age at any time. To ensure this verification proceeds smoothly and correctly, each user of Pokahnights must have a verified Days of Poker account. At physical locations (Pokahrooms), an additional identity and age check may be conducted.

If a participant is younger than the permitted age, access will be immediately denied or revoked. In case of doubt, access may be temporarily suspended until age is confirmed. Individuals denied access are not entitled to any winnings from poker activities organized by Pokahnights. Buy-in amounts will not be refunded.

5.2 Privacy Policy

Your membership with Pokahnights and participation in the Pokahnights Orbit are subject to our Privacy Policy, which explains how we collect, use, and protect your personal data.

5.3 Applicable Law and Jurisdiction.

These Terms are governed by Belgian law. Any disputes will be exclusively settled by the courts of Antwerp.

5.4 Amendments to the Terms and Conditions

Pokahnights may update these Terms and Conditions. Important changes will be communicated via the Days of Poker platform or email. Continued use of the platform implies your acceptance of the updated terms and conditions. We advise all followers of the Pokahnights orbit to regularly review the documents in the paperwork section.
